Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website at tothevoid.com and the VOID mobile applications for iOS and Android (together, the “Service”) operated by Aimless Fish Productions (“VOID,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and acceptance

You must be able to form a binding contract in your jurisdiction to use the Service. The Service is not intended for children under 13. If you are between 13 and the age of majority where you live, you may use the Service only with a parent or guardian’s consent where required. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Material changes may be communicated through the Service or by email where appropriate. Your continued use after the effective date of changes constitutes acceptance, except where prohibited by law. If you do not agree to the new Terms, you must stop using the Service.

2. Description of the Service

VOID provides informational tools, including media ratings and related content (“VOID Scores” and related breakdowns), search, and optional scanning features. VOID Scores and related text are generated using automated analysis and third-party data sources and are intended to help you make informed viewing or reading choices. They are not professional advice (including legal, medical, or psychological advice). You should not rely on VOID Scores as the sole basis for decisions about what is appropriate for you or your family.

3. Accounts

Creating an account is optional. If you register, you may provide credentials (such as email and password) or use third-party sign-in (for example, Sign in with Apple or Sign in with Google). You are responsible for maintaining the confidentiality of your account and for all activity under your account. You must notify us promptly of any unauthorized use.

Account deletion. You may request deletion of your account in accordance with our Privacy Policy, including through in-app controls where available, or by contacting contact@tothevoid.com. We may delete or suspend accounts that violate these Terms or for other legitimate reasons.

4. Subscriptions and purchases

Certain features may require a paid subscription or in-app purchase. Payments are processed by Apple App Store or Google Play (and/or our subscription management provider, such as RevenueCat). By purchasing, you agree to the applicable store’s terms and payment policies.

Subscriptions renew automatically until cancelled. You can manage or cancel subscriptions through your Apple ID or Google account settings. Fees are charged at the then-current rate unless we notify you otherwise. We may change pricing with reasonable notice where required by law.

Refunds. Refund requests are handled by Apple or Google according to their policies. We do not control those decisions except as required by law.

5. User content and license

You retain ownership of content you submit (such as images or feedback), subject to the license below. You represent that you have the rights needed to submit that content and that it does not violate the law or these Terms.

You grant VOID a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, and create derivative works (such as derived scores and summaries) as necessary to operate, improve, and promote the Service, and to sublicense these rights to our service providers (for example, cloud hosting and AI providers) solely for those purposes.

Where you choose to share content publicly in the Service, you understand that others may be able to view or copy that content. Do not submit financial account numbers, Social Security numbers, government ID numbers, health information, or other highly sensitive information through the Service unless we explicitly request it in a secure way.

The Service, including its name, logos, UI, visual design, and documentation (excluding your user content), is owned by Aimless Fish Productions or its licensors. The VOID Rating Guide methodology and related materials are protected as trade secrets and proprietary information. You may not copy, modify, or distribute our materials except as expressly permitted.

8. Third-party services

The Service relies on third-party services (such as authentication, cloud infrastructure, subscription management, media metadata, and AI). Your use of those services may also be subject to their terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. VOID SCORES AND RELATED CONTENT ARE INFORMATIONAL AND MAY CONTAIN ERRORS OR OMISSIONS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOID APP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Indemnity

You will indemnify and hold harmless Aimless Fish Productions and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your user content, your use of the Service, or your violation of these Terms, to the extent permitted by law.

12. Dispute resolution

These Terms are governed by the laws of the Alberta, Canada, excluding conflict-of-law rules. You agree that the provincial and federal courts located in Alberta have exclusive jurisdiction over disputes arising from these Terms or the Service, except where prohibited by law. If you are a consumer in the EEA, UK, or another jurisdiction with mandatory consumer protections, those local rights may apply.

Informal resolution. Before filing a claim, you agree to contact us at hello@tothevoid.com to try to resolve the dispute informally.

13. General

These Terms together with our Privacy Policy constitute the entire agreement between you and VOID regarding the Service. If any provision is invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Apple and Google are not responsible for the Service or content, except as required by their respective app store terms.
